jumped cover fbi agent buy automatic weapons. prosecute verse recommended an eight-year sentence. the defense hopes for five years and three months. also set to be sentenced today, political consultant keith jackson who worked with yee on a couple of campaigns. he pleaded guilty to racketeering. it was jackson who led authority to yee a bay area man is behind bars for testing out a red corvette and killing a salesman in a wild crash. kpix 5's anne makovec joins us in the newsroom with more on the test drive that ended tragically. anne. >> reporter: that driver is from union city. now under arrest in ontario down in southern california. here's his picture. police say 28-year-old alex demetro took out a car on a test drive from a carmax car dealership. they say he was high on drugs and crashed into a tree. this man died in the crash. a carmax employee who came with demetro on that test drive named warren smale. police say he was riding in the
passenger seat of the red corvette when demetro sped and lost control. smale's coworkers held a vigil at carmax last night. >> he was an amazing person like a father to us. so we are all here together so we're all family. >> demetro was arrested and charged with vehicular manslaughter and felony driving under the influence of drugs. carmax officials sent us a statement saying their hearts and prayers go out to their associate's family. >> so sad, anne. how about the investigation? where does that stand? >> police say they don't believe that alcohol was a factor in the crash, just drugs. and carmax says it is providing investigators with all the information it has on that suspect. live in the newsroom, anne makevoc, kpix 5. federal investigators looking into the san francisco police department are holding a community meeting today. the department of justice says they want residents' input on ways that san francisco police
can improve relations with the community. the doj opened an investigation into the police department after the shooting of mario woods late last year. the meeting will happen tonight at 6 p.m. at thurgood marshall high school on conklin street. i think we need a cup of tea, the frogs are out. >> i felt like there were spiders in my throat all because of the pollen and extremely dry air mass. >> can you fix that? >> no, but i can give you the report and you can take measures to prepare properly. [ laughter ] i read this really interesting article yesterday in the san jose "mercury news" and the headline says here on the front page, it's el nino done. and i think that's a really fair question, is el nino done? especially when we had record high temperatures 10 days ago and this week we have had a string of temperatures averaging up to 15 degrees above normal and one thing you have to keep in mind during el nino seasons is it's not unusual to have long dry spells.
it's very typical during february to have that. but if we don't see rain with a vengeance very shortly, i have been told that we could see our water restrictions imposed again by the summertime. last time we have had a good soaking was on january 19. no rain today. nothing but clear skies, visibility unlimited, temperatures into the 40s and 50s. except look at livermore!! i felt that this morning. 39 degrees. high surf advisory is in place today because we have the sunshine onshore, we have a very angry ocean and some of these westerly swells are building to 14 feet. again, onshore today, look at these temperatures. 9 degrees above where we should be for this 24th day of february, 70 degrees in san francisco. almost 15 degrees above average in oakland. 70s very common across the santa clara valley and to the north. low in the 70s. pollen report weather watchers ski report that's all coming up at 18 minutes after the hour. and checking the roads right now, it is an easy ride out of marin county right now
if you plan to take the golden gate bridge this morning you won't have any trouble south 101, 580 to the toll plaza. that's a 14-minute ride for your drive time freeways are clear and looks like traffic is moving along at the 101/580 interchange as well so nice and easy breezy as we head on the southbound side of 101 this morning the commute direction. so far, so good at the bay bridge. we haven't had any trouble spots or snags this morning. in fact your approaches to the bay bridge also fairly quiet right now. carquinez bridge to the maze, that's about an 18-minute ride for your drive time t westbound 580 not seeing any problems this morning. and you're clear across the upper deck into san francisco. if you typically commute from hayward to foster city via the san mateo bridge it's business as usual 13 minutes between 880 and 101. and taking a look at conditions along 580 westbound as you head towards the dublin interchange, we have those new express lanes that opened up. we have one on that westbound side, two eastbound and it's actually helping to ease congestion. showing a little bit more delays now on 680 as a result
because folks are hitting that 680 connector earlier than they normally do. things are moving nicely on the westbound side and we are seeing typical slowing westbound 580 out of tracy as you work way towards the top of the altamont pass. rescuers found the wreckage of a small plane in nepal and confirm all 23 people on board died. the plane crashed in a mountainous area during rough weather on wednesday. searchers say the plane appeared to have flown into a mountain. airport official says that plane lost contact after take- off. authorities in fiji say 42 people are dead in the wake of a powerful cyclone. at least four people are missing including an infant who was ripped from his parents' arms in high wind and high water. fiji's government is scrambling to restore power and water right now. on capitol hill, senate majority leader mitch mcconnell is making it clear there will be no confirmation hearing or a full senate vote on anyone

an accident. it's minor southbound 101 at peninsula. reports of a vehicle that may have gotten hit by wood debris in the road. it's over in the right lane. chp is heading to the scene but we're not seeing any delays. still early as you cruise to the peninsula this morning. where we are seeing slightly stop-and-go conditions is that tracy commute. it's typical this time of the morning around 11th street to 205 making that connector over to westbound 580. slows down around this time this morning. but once i get to north flynn it eases up. you have no delays heading towards 680 the dublin interchange. you can even see in our live shot traffic is moving along nicely making that connector over to 680. in fact, from the top of the altamont pass to 680, that's only 15 minutes right now so it's bearable. bay bridge looks good no problems or snags. no metering lights yet. traffic is clear out of oakland across the upper deck and no delays at the fremont exit. clear both directions in and out of san francisco this morning. haven't had any problems on the san mateo bridge. it's been a nice ride as you
work your way westbound the commute direction for all those folks making that trek from hayward into foster city. eastbound no delays right now. in fact, 13 minutes to go across the span of the san mateo bridge. and the golden gate bridge we are seeing more cars on the roads but overall that marin county commute is quiet this morning. 14 minutes that's your drive time from 580 down into san francisco. and if you plan to take the richmond/san rafael bridge this morning, you can see in our live shot traffic is cruising along no delays near the toll plaza or across the span. taking a first look at traffic through the south bay it's been quiet northbound 101 out of san jose. in fact, clear conditions along most of the south bay guadalupe parkway looks good 280 not seeing any delays. santa cruz mountains highway 17 also quiet right now in both directions. and taking a look at the nimitz freeway northbound 880 at you pass the coliseum, traffic is clear all the way into downtown oakland. south 880 so far, so good through oakland. you're going to see some extra volume though as you start hitting 238 heading southbound into hayward and fremont.

the bay is clear, and we have clear starry skies in our inland areas. 39 degrees in livermore. otherwise 54 the closer you get to the bay of water, it's now 42 degrees in santa rosa. high surf advisory in place this morning until tonight. some of the swells up to 14 feet. that's offshore. onshore, sunny skies and unseasonably mild conditions. we have a slight chance of rain in the far reaches of the north bay by friday evening. satellite and radar not a lot going on today. a little bit of light precipitation well to the north of the bay area. i'll step out so you can see the flow of the jet stream. we have this area of low pressure, the tail end is sideswiping the northwestern quadrant of the state of california so a few high clouds from time to time but otherwise, dry skies from eureka into monterey. 50 in the high sierra. where it is time for the snow report. if you are heading to the south shore today heavenly valley packed powder 24 lifts available pristine conditions in squaw valley always my favorite run of the day red dog
express, yeah. that's the black diamond. that's the one frank likes the best, too. temperatures in the bay area today into the 70s from pacifica, moss and montera beaches to even half moon bay at 70. 70s around the central bay, oakland through alameda into emeryville should be right around the low 60s. 74 in san jose. winds north 5 to 15 miles per hour. a slight chance of rain showers on friday far north bay. otherwise, partly cloudy skies on saturday. we'll notice increasing cloud cover on sunday with another slight chance of rain showers in the north bay. the dry weather pattern will continue. and again a lot of people asking about is el nino on vacation? this is very common. when you do have a very strong el nino you will have long periods of dry conditions. if he would don't see the rain return -- if we don't see the rain return -- >> it's been a month. >> we had rain last week but as far as substantial soaking rains are concerned, you're right, it's been about a month because we were all kind of warding it off for the super

everybody, the surf is high, the pollen is high. temperatures are high. details ahead. >> we are starting to see delays at the bay bridge plus an accident on 880. details coming up. good morning. it's wednesday, february 24. i'm frank mallicoat. >> i'm michelle griego. we're following breaking news right now in milpitas. that's where police say a suspect tried to rob a gun store and one is inside. kiet do is live where this is all happening. >> reporter: no official update just yet since all the officers are very busy trying to catch this suspect who is still inside the store. but here's what we know so far. steam overnight a group of thieves -- sometime overnight a group of thieves broke into target masters in milpitas a gun store and gun range. that gun store is it right next door to the police department headquarters. somehow, police were alerted and apparently three of the suspects fled the scene then were arrested a short time
later but at least one suspect is still inside the store. officers have i surrounde. a very active scene here in milpitas. once we get official word as to what's going on, what tactics they are using, we'll let you know. kiet do, kpix 5. a gruesome discovery in a bay area marsh. a woman's dismembered body. she was found on the sunday night in the fremont area near the dumbarton bridge by fishermen and now officers are doing a suspicious death investigation on marshlands road. the search teams combed the shore yesterday and the coroners van arrived last night. the area is popular for workouts and locals say they have never sensed trouble there before. >> it's been fine, yeah. every now and then a little
skunk or a little goose or something. but no bad people. >> they are not sure how long the body was in the water. an uber driver attacked an employee at mineta san jose airport. this driver attacked the employee who confronted him for speeding last thursday then police say he picked up a passenger in his mercedes and drove off. airport officials say the employee is okay. in san jose, rideshare companies are not required to run driver fingerprints through law enforcement databases. the city randomly does that for 1% of the airport drivers. in a statement, uber said: police say a bay area man took a car out for a test drive and a car salesman died. kpix 5's anne makovec reports from the newsroom. >> reporter: police say he took

at one of the buoys off pacifica 15-foot surf. average high san francisco 61. instead today 70. we have temperatures up to 8 degrees above where they should be for this time of the year in the san jose area. warmer to the south towards gilroy 77 degrees. otherwise, 74 in campbell, cupertino. good morning, danville in the low 70s. it will be 71 degrees in pittsburg. north bay numbers stacking up from stinson beach at 69 through 72 degrees in sonoma and glen ellen. and around the far reaches of the north bay, you will see a chance of rain. i'll tell you when you'll see those raindrops coming up at 48 minutes after the hour but right now, here's gianna. accident south 880 at dyer four cars involved, blocking the middle lanes causing slow conditions as a result. chp heading out to the scene. no word if any injuries are involved. but we are starting to see some delays as you head through there on the southbound side of 880. backing up at least about industrial at this point so an extra five minutes is what you're going to need for your
drive time to make your way through the mess. heading across the san mateo bridge though traffic is very quiet no delays from hayward to foster city. north of there 880 looks good. extra volume starting to see a few more cars on the road northbound heading into downtown oakland. lots of company at the bay bridge. you're making friends, backed up all the way beyond west grand at this point almost to the maze slow-and-go conditions metering lights are on. looks a little sluggish as you work your way up the incline then clear into san francisco. now we have this accident south 101 at peninsula avenue. a vehicle hit some wood debris in the roads off to the side of the road so not blocking the main lines of 101 so if you have a flight to catch at sfo north- or southbound traffic is looking good through there but we are starting to see delays through highway 4 antioch and pittsburg. stop-and-go conditions coming off the antioch bridge and then slowing down as you work your way through pittsburg. looks a lot better once you hit the eastshore freeway. happening today, one massive heap of dirt will no longer be a blemish for the bay area.
the park district is giving the mound at berkeley's mclaughlin eastshore park a makeover. dubbed the dirt hotel this mount has been growing for over a decade. we're told contractors used the spot to the dump debris. starting today, the park district is closing the area off and getting out bulldozers to take at least 15 feet off that massive pile. it will also add picnic tables and pathways but some park regulars they don't want to see the change. >> it's not going to be a good change. it's beautiful the way it is. >> it's a cool spot as is. >> maybe do some plantings. but why rip up what's already nice? >> crews will be working on that section of the park through the summer. it's scheduled to re-open in august. politics. donald trump and his campaign riding high this morning after another pre-election win in nevada. the battle for second place still up in the air with ted cruz and marco rubio in a too close to call race right now. during a victory speech in las vegas trump said he is anticipating a clean sweep. >> we have had some great numbers coming out of texas.

it's "hump day," wednesday, february 24. no reports of local airport delays. we have clear skies and we have temperatures going up to a good 15 degrees above average. i'll pinpoint the warmest location in less than 4 minutes. in the north bay, somebody baked a batch of deadly cookies left them where animals would find them. the poisoned treats placed a a ranch near sebastopol. the deadly ingredient was oleander and a horse and dog died from eating them. another animal ate a small amount and is being watched by a veterinarian. they are still looking for who left the treats. and peta is offering a reward to find the person hurting dogs in hercules. they want to stop whoever is leaving tacks at ohlone dog park. the organization is ready to pay 1 thousand dollars for information leading to an arrest and conviction. more than 400 tacks were scattered around the park between late january and early february. some dogs were taken to vets after swallowing tacks. a man famous for youtube
pranks isn't joking about how he was treated by screeners after the sfo. the man says he was taken into a private room for secondary screening over the weekend and told to remove his turban. he said it wasn't a problem until he asked for a mirror to put it back on properly and then says he was told, quote, there are no mirrors, just walk down the terminal to the nearest restroom. >> why did you take me into a private screening room to undress me and then tell me in order to redress myself i got to go walk to a public bathroom without my turban on? >> a turban is the essential part of the sikh way of life. he says he will ultimately walk to that restroom uncovered but was upset about tsa's lack of sensitivity. tsa says they followed standard security protocol. the public got to give their two cents about plans to tear down a main artery in and out of san francisco last night. the 280 extension. the project would reshape the south of market neighborhood.
dozens packed last night's meeting in potrero hill. planners say bringing it down would open more land for development but many residents say the change will limit their transportation options even further. >> there are concerns about a tear-down of 280 would exacerbate the exclusion of the south part of the city from the rest of the city. >> we really need to look at san francisco holistically as part of the entire city. >> the city showed other projects in the works including extending caltrain underground to the new transbay terminal, building an underground loop for the future high-speed rail cars to turn around and replacing the 4th and king caltrain station with new development. >> i don't know. when you're heading north on a busy day and 101 is all the way back towards candlestick. >> no, no. >> going over to 280 is a nice refreshing little change. >> it's a great option. >> and 3rd street. >> it's so pretty. >> one of the nicest rides in america. >> we'll see how that goes.

[ laughter ] >> you're here. hopefully 280 i don't know that's a tough one there this morning. right now where we are seeing problems though is 880 southbound right around whipple. four-car accident blocking the middle lane but everything is over to the right shoulder so there's some relief in the accident. but the damage is done. we are seeing a backup at least to industrial. maybe beyond that at this point. in fact, our maps showing further because the morning commute is heating up on the southbound side of 880 so keep that in mind. you're definitely going to see slow speeds especially if you plan to take the san mateo bridge. on the bridge itself traffic is okay between hayward and foster city. just getting to the bridge will slow you down a bit. bay fair we have some delays for bart originating out of the bear fair this morning in the dublin, pleasanton and fremont direction about a 10-minute delay. it's recovering so they should
get back on track soon. the rest of mass transit is on time as far as ace and caltrain go. the tiburon to san francisco, they are still doing dock maintenance on the ferry. they have bus bridges in place no ferries. elsewhere you have some trouble at the bay bridge. metering lights are on and traffic is starting to stack up through there. our approaches still holding steady not seeing too many problems on the eastshore freeway just yet. and, of course, delays as you head towards the metering lights. it's clear though across the upper deck into san francisco. stop-and-go conditions westbound 580 altamont pass to 680. 18 minutes for your drive time. a lot of delays around north flynn, grant line and connecting to 680. express lanes are open in both directions to ease congestion making the tri-valley commute. and northbound 101 out of san jose, starting to fill in. business as usual, though, right around 280/680 connector. northbound 101 traffic is

chance of rain nothing measurable around sonoma county. we need rain to settle down the pollen. we have medium to high counts again today. the trees continue to blossom with the alder, ash and juniper. with the drier air tomorrow the counts will be higher. satellite and radar nothing going on. we have an area of low pressure to the north of the bay area. that is providing some rain showers now to the pacific northwest. and we have had a lot of snowfall in the whistler area. record amounts of snow there. as far as el nino and where is it? to the north. we have actually been doing okay. 85% of rainfall for our average year. los angeles has been missing any kind of rainfall from this el nino season. but look at redding at 101% though. our water year to the north doing extremely well, healthy. no snow in the greater lake tahoe area over the weekend. currently it's 21 going up to 50. sunrise at 6:49. by the time it sets tonight these are the numbers we'll

after suspects tried to rob a gun store. we're told now all the suspects are in police custody. kpix 5 reporter kiet do has been reporting on this for us and has the latest. >> reporter: this active scene is slowly winding down now. we are seeing a lot of the equipment and officers even the s.w.a.t. teams leaving the scene. no official updated yet since all the officers are getting debriefed now but all suspects are in custody. sometime overnight a group of thieves broke into target masters in milpitas. it is a gun store and a gun range. it closes at midnight and the break-in happened around 2 a.m. the thing is that gun store is literally right next door to the milpitas department headquarters. somehow police were alerted and apparently three of the suspects fled the scene and were arrested a short time later. but at least one suspect remained inside the building and officers surrounded it. officers were in contact with that man and whether or not he surrendered or police went in and got him we don't know. the store manager is here
