here in washington. 8:00 p.m. in acura, turkey. wherever you're watching from around the world, thanks very much for joining us. we begin with a very dramatic escalation in the battle for the race for the white house. ted cruz is now calling out donald trump over a threatened lawsuit. cruz saying trump's threat stems from a cruz tv ad. the ad uses comments trump made to nbc back in 1999 when he said, he was, quote, very pro choice. ted cruz's message to trump, sue me. >> donald's lawyer sent our campaign a cease and desist letter. and this letter, i will say, having practiced law for many, many years, this letter is one of the most remarkable letters i've ever read. mr. trump's lawyers contend that that advertisement you just saw is, quote, material -- is an attempt to materially mislead the public. and indeed provides more detail. he says that this attack ad, is what he calls it, is, quote, not only completely disingenuous, but replete with lies, false, defamatory and destructive statements and down right fabrications. mr. trump's

to clean up the washington mess. meanwhile, ben carson won't let up on ted cruz for what carson aides call dirty tricks, sending this e-mail erroneously suggesting carson may drop out. cruz has apologized but carson isn't satisfied, telling buzzfeed not to take corrective action is tacitly saying it's okay or like hillary clinton said after benghazi, what difference does it make. carson said it doesn't rise to the level of benghazi but i'm saying it's the same kind of attitude. and carson is really trying to capitalize on all of that and is trying to raise money off of it. he even on his website, which is pretty popular among his supporters put up a voice mail that apparently came from cruz headquarters to captain precincts in iowa saying that he was suspending campaigning, clever language there. jake, he was expected to be back on the campaign trail today right where you are in new hampshire where the latest poll shows him at just 2%. jake. >> dana bash, thanks so much. we'll hear more from barbara bush later this h

let's talk more about this with cnn senior washington correspondent joe johns in henderson with the clinton camp. in 2008, she picked up popular vote in nevada over obama, he got most of the delegates. according to politico, by mid january sanders hired twice the number of staffers on the ground there. can clinton afford -- i guess you can't afford to be overly confident about nevada. what's she doing differently? >> reporter: nevada is a critical test for hillary clinton, fred. and the simple fact of this is that after losing in new hampshire, after that very close win in iowa, she needs to pick up a little momentum. it is a big test for her, even in advance of the south carolina primary that comes a week after next saturday, the test for bernie sanders of course is nevada is a very diverse state, so you have a lot of latinos, african americans, and generally speaking when he was in iowa, when he was in new hampshire, that was a much more narrow demographic group of people, constituents and voters. coming here, he can show that he is a candidate who has a much broader appeal. we will have

his sudden death has ignited a political battle in washington that is spilling over to the campaign trail. joe johns live at the supreme court with more for you this morning. >> reporter: good morning, carol. justice scalia had such an enormous outsized voice on all issues that mattered most to conservatives in the legal world and now his death coming at a time in the midst of a huge election battle in the united states has got people in this building and across the country wondering what is going to happen next. the body of justice antonin scalia returning home to virginia this morning. the 79 year old died here in his sleep at a texas resort over the weekend. funeral plans for the supreme court's conservative voice are underway and so is the epic political battle for his replacement. >> president obama in my view should make that nomination. i hope he does it as soon as possible. >> there is no way the senate should confirm anyone that barack obama tries to appoint in his last year in office to a lifetime appointment. >> reporter: the republicans fear another liberal nominee would tip t

i went to washington to distance myself from it. you see bernie sanders saying i'm not a democrat or republican, i previously was an independent, trying to somehow not seem like you're just somebody who goes to washington, d.c. and casts votes. congress has about a 15% approval rating right now. i don't think you want to hitch your kite to that institution right now. >> right. on governors, you know, specifically jeb bush would say governors should be president, not a senator. he was comparing himself to marco rubio, essentially saying he, jeb bush, is better for prime time as an executive of a state, he's dealt with natural disasters and economy, employees, et cetera. what do you think the strongest attribute of a governor is going into the oval office? >> that they don't have to vote on things. look what's killing hillary clinton. her vote for the iraq war. that's what bernie sanders is nailing her on that. but the idea that a governor has created his own administration. you can judge but it would be impossible to say that governo

joining me from washington, our cnn political director, mr. david chalian, and cnn's chief political analyst who you will see also until the wee hours tonight, gloria borger. so great to have both of you on. david chalian, to you first, what are the top three things you will be watching for? >> well, start, brooke, with what you just read there in your intro, which is independents. i believe that -- one of the first things i'll look at is to see how independents split here. in our last tracking poll, they were splitting between the two parties. they can choose to play in either the republican or the democratic party. which one do they choose to play in and how does that affect the trump and sanders vote totals? those are the candidates that have been drawing from the independents. so that is the first thing i'm watching for. i'm also watching for what the voters tell us they're looking for. this is the head versus heart argument. i want to see, are new hampshire voters coming out tonight to back the person they think has the best chance of win

recognizing that, you know what, we need somebody who is not part of the problem right now which is washington. if you are looking at the results here in south carolina, 40% of the voters went with somebody who has never been elected into political office. so dr. carson's message of, you know, heal, inspire and revive is something that a lot of the voters are still wanting in their president. >> all right. jason osborne with ben carson and ben carson is still in the race, not going anywhere, as he said. thanks for being with us. gentlemen, thanks for being with us. ben carson not leaving the race. a lot of ted cruz races say, he's got to get out, because they think ben carson is pulling directly from him. >> i can see why they think is that, and more importantly, they have to convince ben carson of that if they have any hope for him leaving the race for that reason. there is going to be a certain momentum that is going to be lead toward -- when we talk about the delegate counts after super tuesday and get through 12 additional states and the thresholds come in, and if you come in without 20%,

for the second time in a month the president highlighted that he thinks he failed to unite washington. does this surprise you? >> no, it doesn't. i mean, what we're seeing is a very humble president who recognizes that at seven years into his term there are still some things that he wished he could have gotten. it's the epitome of the american dream. he wanted the language to be less visceral, the rancor to be toned down. and what he sees now is a bernie sanders campaign and a donald trump campaign which have tapped into an anxious, which have tapped into a worry. and all of you us, even myself included, sometimes i have to take a step back and realize my language in this political discourse is not what it should be. and i'm not absolutely certain how we got there. >> how so? >> but i know this is something that weighs on barack obama's heart. >> you think sometimes you say things you shouldn't say or too inflammatory? >> i don't necessarily think it's too inflammatory. but we've gone to let our emmotions cloud our better judgment. just for me to harp back on an earlier segment, we're

she joins us from washington. what are the latest details? >> reporter: we know justice scalia went to texas on friday for a hunting trip at a secluded rezorts. he had dinner on friday night. the ranch owner had been speaking to reporters and said scalia was entertaining and engaged throughout the dinner. around 9:00 p.m. he said he had a long week and wanted to get a good sleep. a separate source tells evan perez that scalia said he wasn't feeling well on friday. the next day the range owner checked on scalia because he didn't show up for breakfast and lunch and found him in bed lying in repose. the sheets weren't wrinkled, no signs of foul play. it appears he died in his sleep of natural causes and the family has reportedly requested for him not to have an autopsy. >> in terms of political fallout, a fight brewing over the successor between the white house and republicans. any timetable as to how it could play out? >> likely it will be within the next month we'll hear about a nomination based on previous nominations coming from president ob

i think i need to ask you about the story in "the washington post." donald trump is now talking to rudy giuliani. the former mayor of new york city is now advising him on his campaign. he doesn't say he is supporting donald trump. the mayor says there are a bunch of other washington and new york insiders giving advice to donald trump. interesting. >> it is interesting. donald trump is taking counsel from anyone else from outside. he does trust his wife, melani. to find he has a circle of former political leaders giving him advice and he is taking it is a real story. donald trump is not known for heeding counsel of others. he is known for shooting from the hip. this could be interesting in terms of what we hear from him in the coming weeks. >> shooting from the hip has worked for him. >> it's paid off. >> let's get at the south carolina numbers. so interesting with ted cruz and marco rubio. ted cruz playing this as a tie for second. 1,000 vote difference out of several hundred. they needed to win. this is what ted cruz saying on abc this week. basicall

and that is what we haven't seen in washington for at least seven years. and it is the reason that i support marco rubio. your question about a pathway to a majority i think is pretty easy to understand. if you look at national polls, essentially donald trump is a 30-some percent supported individual. and what you really have, is you really have 65 to 70% who want somebody else, the so called establishment. the problem is they are divided among candidates who can win and candidates who can't win. the old expression in the republican party and i think it still holds true is you have got to support. you have got to vote for the most conservative candidate that can win. >> well but here is the thing. i think that it might be simple on that level to understand it. but i think that that assumes some things that may be very much in question. for instance, trump is not at 30%. by most polls he's higher. so say you need closer to 40. fine you still have 60. but that assumes one path. there is no reason to believe that cruz supporters would go with rubio. certainly

in the campaign, you've heard a lot about washington and wall street. we all want to get secret, unaccountable money out of politics. that starts with appointing a new justice to the supreme court who will protect the right of every citizen to vote, not every corporation to buy elections. and we also agree that wall street can never be allowed to threaten main street again. no bank can be too big to fail, no executive too powerful to jail. but if we listen to the voices of flint and ferguson, if we open our hearts to the families of coal country and indian country, if we listen to the hopes and heartaches of hardworking people across america, it's clear there is so much more to be done. the truth is, we aren't a single issue country. we need more than a plan for the big banks. the middle class needs a raise! and we need more jobs! we need jobs that pay well and can't be outsourced, jobs that provide dignity and a future. we can do it by unleashing the innovation of our entrepreneurs and small businesses. we can do it with new investments in manufacturin
