sarah murray was there. what did you hear from the justices? >> reporter: it was a very divided court today. this is the first abortion case this newly conservative majority is hearing. we did hear a signal from chief justice roberts and cavanaugh in the way they're questioning to uphold this law. an abortion law that would require doctors to have admitting privileges at a local hospital. critics say it would bring the number of doctors in louisiana down to one doctor. now, this new conservative majority down to one case. it was very divided. there was a bunch of backlash by liberals, ruth ginsberg, why this was the law when it was generally a safe procedure. a decision will not come until the summer. >> admitting privileges, doctors admitting privileges is something we have seen state to state to state. so this could have huge implications. >> reporter: and it's not whether you're overturning roe v. wade, it is one of these cases that could begin to chip away at abortion rights if the conservative votes to uphold the law. similar to a law stru

our political correspondent sarah murray is joining us from outside the federal courthouse. what's the latest? >> reporter: it was a very bizarre day in court. this hearing stretched for more than four hours and the judge did not make a ruling today on whether she's going to allow roger stone to have a new trial. there was a point in this where she said in the next room, i have 11 of the jurors from this case. then both sides called in a couple of these members of the jury to testify. they answered questions about whether the foreperson in this jury tried to sway them one way or another. whether there was any outside information brought in during deliberations. there was questioning from the judge as well as roger stone's attorney of the foreperson in this jury. she was in the identified by name during the proceedings. we know from previous reporting her name is tameka hart. she was questioned at length about her social media postings. this is the basis in part of roger stone's appeal for a new trial. he's alleged juror misconduct. this wrapped up pretty ababrupt. she said s

cnn sarah murray is joining me. now, sara, some of the jurors may have to testify? is that what is going on? >> yes, some of them already are. and looking at the twitter attacks and the judge warned about if ten shall harm for jurors if they are identify and pointing to the president's twitter feed, and he tweeted after she said this, rarely so much a juror to be so taied as in the roger stone case. and she was totally biased as is the j.j., and the president is insisting this is a miscarriage of justice, and what the judge is trying to do to get to the bottom of the request for a new trial by stone. this is based on the allegation of juror misconduct. it is like the television reveal, but we could not see it, but we could hear it. and so she said i have 11 members of the jury that i have called today. and dr. amy berman is asking how they reached the conclusions, how did you pick the foreman for the panel, and now she is moving on to find out if any of the four-person journey is biased and it has been dramatic as far as court days go. >>> and now, just saying that

our political correspondent sarah murray is here in "the situation room." he's on track now to be sentenced on thursday. what are you hearing? what's the latest? >> there was a whole back and forth about this, not necessarily in court but sort of because it was over a conference call. amy jackson held a call. she's the judge. stone has been push fing for a w trial. the government has opposed that. she said i'm going to deal with this separately from the sentencing. we're going to move forward. we're going to do this sentencing on thursday. what was really interesting is she did not address the controversy that has been playing out in the background of this case. obviously, the judge has been criticized by president trump who suggested she has some bias here. we saw the four prosecutors who were on roger stone's case resign from it after bill barr intervene and pressed for a lesser sentence than the seven to nine years that prosecutors suggested for roger stone. this is playing out in the backgrou background. she addressed none of that on the call today. >>

>> sarah murray, thank you very much. this is how nancy pelosi just responded to these emails in a tweet, trump hid these emails and other documents. his excuse was a phony complaint about the house process. why won't trump and mcconnell allow a fair trial? what do you make of that argument? >> well, i think that it is something that they're going to really drill down on. and these unredacted emails really do raise questions because you had omb general counsel send a letter to the gao, basically saying that they had held up this money and that the reason why they held up this money, but it didn't make a big difference, that dod was telling them there was no risk that this money wouldn't go out. what you see in these emails is the direct opposite of what omb said, that there was a risk that this money was going to be held up and that there was a legal concern. it goes against what republicans were saying, that this was the deep state, they just disagreed with policy. the concerns being raised were not about policy. they we

sara murray joins us with more. sarah, this undermines a key white house defense? >> it does. and one of the key questions is why the president finally relented and decided to release that money and now we're learning another possible explanation which is this skplants from the whistle-blower that president trump was aware of. by the time president trump caved, releasing $400 million in military aid to ukraine. he already knew a whistle-blower raised red flags about how the president froze the funds. according to "the new york times," trump was briefed on the complaint in august. the new report could shed light on why trump ultimately released the money on september 12th and why he was so insistent when he spoke to ambassador gordon sondland on september 9th that there was no quid pro quo. >> so he's going what do you want, what do you want? i hear all of this, what do you want? and i say to the ambassador in response, i want nothing. i want nothing. i want no quid pro quo. >> reporter: democrats allege the no quid pro quo claim was just another attempt to cover his tracks. >>

sarah murray is live at the federal courthouse with the latest. >> reporter: you're right, john. today is the day paul manafort could learn if he's going to spend the rest of his life in prison. prosecutors asked for up to 25 years for the eight crimes paul manafort was convicted of in virginia including defrauding the u.s. government, failing to pay taxes. he hasn't shown much remorse. he's blamed everyone else for his crimes. for his part, paul manafort has asked the judge for leniency but never took the stand in his own defense. today he'll have an opportunity to speak before he's sentenced. this is a 69-year-old man. he's already been incarcerated about nine months. his health has been declining. at times he's been using a wheelchair, a cane. that could be his last attempt to ask the judge for leniency to make a final plea. this is the first round of sentencing for paul manafort. next week he will be before a different federal judge for crimes of witness tampering and conspiracy. this is one of two potential jail sentences. back to you. >> thank you very much for the update.

more now from sarah murray who joins us from the white house. some questions were answered by the president. but the fact of the matter is, a lot was left unanswer. >> that's right. we got the answer that the president wasn't recording james comey, despite raising that potential on twitter. some 41 days ago. what we didn't get an answer about why he brought this up in the first place or why the white house decided to let this story linger for weeks and why the president refused to answer whether the tapes exist. it was interesting talking to republicans close to this white house, because they see it as a severe misstep on the part of this president. remember, trump's initial tweet is what inspired james comey to leak some of the details of his memos from meeting with trump. that's what unevidentably what led to the special counsel named to the russia investigation, which is exactly what the president wanted to avoid. what he ended up causing by these tweets about the tapes that don't exist. >> the white house was asked about a number of things,

sarah murray is out front. >> donald trump is aiming to ratchet up u.s. defense spending as he prepares his first presidential budget. >> this budget will be a public safety and national security budget. it will include an historic increase in defense spending to rebuild the depleted military of the united states of america at a time we most need it. >> budget official telling reporters today that trump will ask for $54 billion in defense spending. that's a 10% increase. and more than the total discretionary spending for the entire state department and environmental protection agency combined. but so far, there are few details about how the add strags would pay for sharp increase in military spending. most federal agencies will see their budget shrink, and the epa and frn aoreign aid expected toe sharp cutbacks. we will do more with less and make the government lean and accountable to the people. trump's security focused budget sure to be a key topic in his address to congress tuesday. but all eyes are on what trump will say about repealing and replacing

a source close to trump did tell my colleague, sarah murray, last night, saying there's consternation within the white house about conversations between priebus and the fbi. the source saying this is the type of distraction the president doesn't need right now. he's trying to focus on his agenda and has grown frustrated by all the staff stories, this source went on to say. so a complicated topic that has aircra a lot of people on capitol hill concerned. >> the intrigue in this process, he doesn't like. it's a distraction. elise, there's this reporting we're hearing on president trump's national security advisor. his brand new one, mcmaster with his boss on the term radical islamic terrorism. explain what mcmaster said and really, i guess, what he meant or how much of a break this was with trump. >> you know, brianna, that president trump and others like former national security advisor mike flynn kept referring to groups like isis and others as radical islamic terrorism. and you know, that term was a loaded term. president obama did not want to use it because they thought this kind of

sarah murray at the trump rally in hershey pennsylvania. you have been talking to your sources tonight. trump trying to close the deal. what do you expect moments from now when when he takes the stage? >> reporter: erin i think his biggest goal is not commit unforced errors. to try to stick to the the script and paint hirllary clintn as a crooked politician and most importantly to try to move the states like pennsylvania that just a couple of weeks ago appeared completely out of his reach but where we are now seeing polls begin the tighten. it's interesting erin because i've talked to probably republicans across different battleground states and they are still convinced despite the polls tightening that donald trump is not going to be successful on november 8th. even though has momentum and we're seeing polls close in places like pennsylvania and get a little closer. but, but even as they say, they say look this is a candidate who has defied all of our expectations to this point. and everyone is kind of holding their breath to see if he can

we get more from cnn's sarah murray. >> reporter: good morning, john and christine. melania trump made a prayer appearance on the campaign trail, hirs first since she gave remarks at the gop convention where she plagiarized first lady michelle obama. she had a different agenda today. she wanted to talk about what she would do as first lady, and said one of her top priorities would be battling cyber bullying. >>> children and teenagers can be fragile. they are hurt when they are made fun of or made to feel less in looks or intelligence. our culture has gotten too mean and too rough, especially to children and teenagers. >> reporter: now, one thing melania trump did not mention was her husband's own prolific use of twitter. donald trump of course regularly uses it to hurl insults at people in the political arena or people in media who he simply doesn't like. but melania trump did make clear she feels adults are better able to handle the criticism whereas she wants to do more to protect children. it was a speech heavy on what she wants to do as first lady, not so much h

sarah murray is at trump's last stop in tallahassee. trump is still struggling to stay on message. >> he's actually done a get job of focusing on the spike and health care premiums under the affordable care act. he did an interview with rush limbaugh that gets the push and pull behind donald trump. the fight between what his advisers want him to sxa his instinct to fight back. >> i would rather, rush, fight it. even though most people say you should not do that. if you fight it, at least you're telling the truth. other people say stay on jobs. stay on obamacare and repealing it. i would rather fight it but everyone says you shouldn't do it. just go along. >> now, this gives you an idea of why donald trump has repeatedly hit back. not only at the nearly a dozen women who have accused him of unwanted sexual advances but why he continues to go after political rivals in the primaries and he still goes after people like paul ryan who offered only tepid support for him along the way. this is something his campaign advisers have been strugglin

. >> let's start there, sarah murray standing by in johnstown, pennsylvania, our political reporter. trump is supposed to speak there a little while from now what do you think his focus will be? pennsylvania one of those key battleground states. >> it's another one of those battleground states where donald trump is trailing behind hillary clinton in the latest polls and it gives you a sense of how treacherous the map is. and trump, you heard him earlier, seems to be betting the best thing he can do is sprint to the finish and continue to hit hillary clinton along the way, specifically about these revelations that are coming through wikileaks. and when you look at where wear in this campaign, brooke, the big moments have gone by. the conventions have passed, the debates have passed, these have not significantly turned the tide for donald trump and we're at the point where it comes down to things like fund-raising, ad spending, hillary clinton is outraising donald trump. it comes to grounding and turnout mechanism. this is another place where the clinton campaign has sunk more money, t
